9/29/2019 Notice: We have more than 500 pages of public documents related to the Right of Way, not including thousands of police dispatch records. We have been posting links to online dropboxes that contain the documents, along with posted selections, on our Facebook Page. Please see our Home Page for the latest updates on documents and a news feed there that shows you what is on Facebook. If you are looking for something in particular here but can't seem to find it just give us a yell and we'll look it up and send it to you or post it for you. Remember we're just regular people and this "hobby" is taking a lot of time -- so apologies in advance if we aren't immediately responsive. We appreciate your patience!
We've tidied things up quite a bit and hope this chronology is a little easier to follow. We have loads of history prior to 1984 that we will eventually post but for the time being we did not want to bog down the most current information. If you struggle with any of the CRMC links simply visit their permit database and enter the file number indicated for more information. Let us know if you need anything.
IMPORTANT NOTE: We are in possession of a lot of individual communications between parties that are a matter of public record. These include emails and letters between, to and from citizens and public entities. However, we have made the intentional decision not to publish those here as we are not interested in further pitting neighbor against neighbor. If we need the additional documents to further illuminate important details or credibility we will reconsider publishing them here. In the meantime, our interest is in finding common ground and working toward intelligent and community based solutions that preserve and improve the public right of way while improving litter and signage conditions. We believe there is plenty of common ground in those areas for us all to work together.

Oct 9, 1984 the site is legally designated by CRMC as a public right of way for access to the coastline. It does not belong to any individual homeowner nor is it part of any subdivision or development. Its legal status was established prior to the adjacent owner's purchase. Nanaquaket Road is not a gated community defined by the bridge
The Parties Involved Are Aware of CRMC Assent Requirements:
Between 2007 and 2009 multiple CRMC assents were granted to the adjacent owner for demolition of existing buildings, construction of new buildings, and construction of a residential boating facility. All of these assents demonstrate knowledge of the process that engages CRMC, a process that requires assent before work begins. They are all available for public viewing at this link. This permit for RIDOT work on the bridge area demonstrates RIDOT's knowledge of the process that engages CRMC for assent.
Attempt #1 to develop the Right of Way: (CRMC FILE 2009-05-34)
May 19, 2009 Plans were submitted (CRMC File 2009-05-034 ) to the town and then to CRMC for consideration as part of the Tiverton Point, LLC development (adjacent owner), that included plans for the Right of Way. February 16, 2010 CRMC issued its decision on CRMC File 2009-05-034 which specifically included on page 4, the PROHIBITION against alteration or blockage of the Right of Way.
Attempt #2 to develop the Right of Way: (CRMC FILE 2018-06-075)
June 25, 2018 RIDOT then alternatively submitted a "rain garden and curbing" request for permit to CRMC for the same Right of Way on behalf of the adjacent owner who stated there would be no cost to the town or state for installation. We have requested the drawings as we have not yet seen them. July 26, 2018 the Town provided endorsement conditional on RIDOT and CRMC requirements, in the form of written comments submitted to CRMC for the application.
However, CRMC did not provide assent for the curbing and rain garden project.
Attempt #3 to develop the Right of Way: (NO CRMC ASSENT APPLICATION CAN BE LOCATED IN THE ONLINE ARCHIVE)
October 24, 2018 The adjacent homeowner submitted an Adopt A Spot Application to RIDOT for the same site. RIDOT did not submit a permit request to CRMC at that time. Construction began for this project on Monday November 12, 2018. The homeowner sent notification by hand delivery to the town manager of the construction three days in advance to the Town, on November 9, a Friday, only 12 business days after requesting an Adopt A Spot from RIDOT to begin with (see the letter here). This work was conducted without CRMC assent. In fact, CRMC issued a cease and desist.
Here are enforcement documents from CRMC that cover their response to the unpermitted development of the site. *PLEASE PAY PARTICULAR ATTENTION TO THE FIRST PAGE WHICH DEBUNKS THE IDEA THAT THE DEVELOPMENT OF THIS SITE WAS NECESSARY FOR STORM WATER MANANGEMENT

IN RESPONSE TO THE CLAIM THAT DEVELOPMENT WAS NEEDED TO PREVENT CAR ACCIDENTS:
We decided to analyze all dispatches of Tiverton Police to accident calls over a nearly ten year period starting with September 9, 2009 through July 13, 2019. Here are the results of that analysis. Five Word Executive Summary: It’s not about car accidents. Here are the details: In total TPD was dispatched to more than 4,750 accident calls town-wide over the nearly 10 year time period studied.
